Terms of Use

1. Acceptance

By downloading, installing or using the DevKit application (the "App") or the DevKit cloud service (together, the "Service"), you agree to these Terms of Use and to Apple's Licensed Application End User License Agreement. If you do not agree, do not use the Service. The Service is provided by the operator of odbs.tech ("we", "us").

2. What the Service does

DevKit lets you watch servers, endpoints, certificates, domains and scheduled jobs from our cloud, receive alerts, publish status pages, share a workspace with a team, open SSH connections from your device and run network diagnostics. Cloud monitoring is a best-effort service: checks run on a schedule from our servers, an outage is reported after the number of consecutive failures you set, and alerts depend on third-party delivery (email, push, chat services) that we do not control. DevKit is not a substitute for your own operational safeguards, and a monitor showing "up" is a measurement at a point in time, not a guarantee.

3. Accounts

You can use SSH and the network tools without an account. Cloud monitors, alerts, status pages and teams require signing in with an email address you control. You are responsible for the security of that mailbox and of your devices; anyone who can read your sign-in codes can use your account. Sessions can be revoked from the App.

4. Acceptable use

You may only monitor, connect to and probe addresses you own or are authorised to test. You must not use the Service to attack, overload or scan systems, to bypass access controls, to send unsolicited messages, or in any way that breaks the law or a third party's rights. Our servers refuse private and local network addresses and apply rate limits; you must not try to circumvent them. We may suspend or restrict an account that abuses the Service.

5. SSH and your servers

SSH connections are made directly from your device to your server with credentials that never leave your device. What you do in a terminal happens on your server under your account there; we cannot see it, restrict it or undo it. Verify host keys and keep your keys safe.

6. Teams

The owner of a team workspace decides who may see and change what. Members see only what they were granted. Owners are responsible for the people they invite and for removing access when it is no longer needed.

7. Plans and subscriptions

Every workspace starts on the Free plan, whose limits are shown in the App. Pro and Team plans will be offered as subscriptions purchased through your Apple Account; until then they are not available for purchase. Once they are: the price, billing period and any free trial are shown before you confirm; subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period; you can manage and cancel them in your Apple Account settings; deleting the App does not cancel a subscription; refunds are handled by Apple under its policies. If a subscription ends, your workspace moves back to the Free plan and keeps its data; anything above the Free limits stops until you subscribe again.

8. Your data

You keep ownership of what you configure and of your servers' data. You can export your data and delete your account from the App at any time (see the Privacy Policy). We keep backups for a limited period to recover from failures.

9. Third parties

DevKit is an independent application and is not affiliated with, endorsed by or sponsored by Apple Inc. Apple, iPhone, iPad and App Store are trademarks of Apple Inc. Slack, Discord, Telegram and other names are trademarks of their respective owners; their services are provided under their own terms.

10. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. We do not guarantee that every outage is detected, that every alert is delivered or that measurements are exact.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for any loss arising from your use of or inability to use the Service, including losses caused by an outage that was not detected or reported, an alert that was delayed or not delivered, or actions taken over SSH. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.

12. Changes and termination

We may update the Service and these terms from time to time. Continued use after an update means you accept the revised terms. We may discontinue the Service or any feature at any time, with reasonable notice where practical. You may stop using the Service at any time by deleting your account and the App.
